1. Acceptance of Terms

By downloading, accessing, or using TopperApp ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and Vardaan Tech ("Company", "we", "us", or "our").

2. Description of Services

TopperApp provides:

• Educational content aligned with RBSE and CBSE curricula
• Chapter-wise study notes in Hindi and English
• Interactive quizzes and practice tests
• AI-powered doubt solving (Nidhi AI)
• Progress tracking and analytics
• Video reels for quick revision
• Copy checking and feedback system

3. User Accounts

3.1 Registration

• You must provide accurate and complete information during registration
• You must be at least 13 years old to use the App
• Users under 18 must have parental consent
• You are responsible for maintaining the confidentiality of your account

3.2 Account Security

• Notify us immediately of any unauthorized access
• Do not share your account credentials with others
• One account per user; sharing accounts is prohibited

3.3 Termination

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for more than 2 years.

4. Subscription and Payments

4.1 Free Tier

• Limited access to basic content
• 10 AI questions per day
• Advertisements may be displayed

4.2 Premium Subscription

• Unlimited AI doubt solving
• All notes and PDF downloads
• Ad-free experience
• Auto-renewal unless cancelled

4.3 Payment Terms

• All prices are in Indian Rupees (INR)
• Payments processed through Cashfree Payments
• Subscription fees are non-refundable except as per our Refund Policy
• We may change prices with 30 days notice

5. Acceptable Use

You agree NOT to:

• Use the App for cheating in examinations
• Attempt to hack, reverse engineer, or modify the App
• Upload harmful, offensive, or inappropriate content
• Use automated tools (bots, scrapers) to extract content
• Interfere with other users' access to the App
• Impersonate other users or provide false information
• Use the App for any illegal purposes

6. Intellectual Property

All content, software, and materials available through TopperApp are the property of Vardaan Tech or our licensors and are protected by copyright, trademark, and other laws.

You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial educational purposes only.

You may not: copy, distribute, modify, create derivative works, publicly display, or exploit any content without our prior written consent.

7. User-Generated Content

By submitting content (notes, questions, feedback) to the App:

• You retain ownership of your original content
• You grant us a license to use, display, and improve the content
• You warrant that your content does not infringe on third-party rights
• We may remove content that violates these Terms

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• That the App will be uninterrupted or error-free
• That all content is accurate, complete, or up-to-date
• Any specific exam results or academic performance
• That the App will meet your specific requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VARDAAN TECH SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or goodwill
• Exam results or academic performance
• Any damages exceeding the amount you paid to us in the last 12 months

10. Indemnification

You agree to indemnify and hold harmless Vardaan Tech, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Jaipur, Rajasthan.

12. Changes to Terms

We may modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.
